Terms and Conditions — Agency & Independent Broker Partnership Agreement
Overview
Sunspot Real Estate ("Sunspot") welcomes collaboration with licensed real estate agencies and independent brokers operating in accordance with Mexican real estate regulations, including the provisions set forth under the Ley Federal de Protección al Consumidor and applicable state regulations governing real estate activity in Quintana Roo.
Listing & Marketing Process
Upon receipt and verification of a property submission, Sunspot will list the property on its official website and promote it through its active marketing channels to prospective buyers. Upon identifying a qualified prospect, a designated Sunspot agent will contact the listing party directly and assume the role of buyer's agent throughout the transaction. In this capacity, the agreed co-brokerage commission shall be payable by the seller upon successful closing of the transaction.
In cases where the originating agency or independent broker plays no active role in the sales process, Sunspot will remit a referral fee of 1% (one percent) of the final sale price, or such other commission as may be mutually agreed upon in writing, once the transaction has been formally completed and funds received.
Eligibility Requirements
To list a property with Sunspot — whether for sale or for rent — the submitting party must confirm compliance with all of the following conditions:
- The property must be an exclusive listing of the submitting agency or independent broker.
- All legal documentation must be current, valid, and in full compliance with Mexican property law, including but not limited to title registration with the Registro Público de la Propiedad and any applicable Régimen de Condominio documentation.
- The listing must include up-to-date photographs and an accurate floor plan.
- The property must be actively available for sale or rent at the time of submission.
- All information provided must be accurate, complete, and truthful. Sunspot reserves the right to remove any listing found to contain false or misleading information.
- The submitting party must hold valid title (escritura pública) or possess duly authorized legal authority (poder notarial) to sell or lease the property on behalf of the owner.
- The submitting party is obligated to notify Sunspot promptly should the property become unavailable, under contract, or otherwise no longer active, so that it may be removed from the website without delay.
Commission Dispute & Compliance
All co-brokerage arrangements are subject to the ethical standards and practices recognized by the Asociación Mexicana de Profesionales Inmobiliarios (AMPI). Any disputes arising from commission sharing or representation shall be addressed in good faith between the parties and, where unresolved, in accordance with applicable Mexican law.
Confidentiality & Data Protection
All information submitted to Sunspot — including property details, client data, and transaction records — will be treated with strict confidentiality in accordance with Mexico's Ley Federal de Protección de Datos Personales en Posesión de los Particulares (LFPDPPP). Sunspot is committed to the responsible handling of personal data and will not disclose any information to third parties without prior written consent, except as required by law.
